Servito betreibt eine browserbasierte Bestellplattform unter www.servito.me. Servito bietet selbst keine Speisen an und haftet nicht für die Richtigkeit der Angebote, Allergene oder Preise.
2.1. Diese AGB gelten für alle Leistungen von Servito im Zusammenhang mit dem Portal.
2.2. Diese AGB ergänzen den Partnervertrag; bei Widersprüchen geht der Partnervertrag vor.
2.3. Abweichende AGB des Betreibers sind nur mit ausdrücklicher schriftlicher Zustimmung wirksam.
2.4. Änderungen werden vier Wochen vorher mitgeteilt; kein Widerspruch innerhalb von zwei Wochen gilt als Zustimmung.
2.5. EU/EWR: Zwingende Verbraucherschutzvorschriften des Wohnsitzlandes gehen vor.
3.1. Der Vertrag kommt durch Unterzeichnung des Partnervertrages oder Online-Registrierung zustande.
3.2. Kündigung mit einem Monat Frist zum Monatsende.

4.1. Das Portal ist vollständig browserbasiert — keine Hardware-Investition nötig. Einrichtung innerhalb von 24 Stunden.
4.2. Der Betreiber erhält eine persönliche, nicht übertragbare, widerrufliche Lizenz für die Vertragslaufzeit.
4.3. Kopieren, Verändern oder Zurückentwickeln der Software ist ohne schriftliche Genehmigung verboten.
5.1. Der Betreiber ist allein verantwortlich für die Richtigkeit von Speisekarten, Preisen und Allergenen.
5.2. Änderungen sind sieben Werktage vorher in Textform mitzuteilen.
5.3. Der Bewirtungsvertrag kommt ausschliesslich zwischen Gast und Betreiber zustande.
6.1. Servito agiert als eingeschränkter Inkassobevollmächtigter. Auszahlung erfolgt monatlich.
6.2. Servito erhält die im Partnervertrag vereinbarte Vergütung zzgl. MwSt., fällig mit Rechnungsstellung.
Datenverarbeitung erfolgt gemäss Datenschutzerklärung, im Einklang mit DSG und DSGVO. EU/EWR-Nutzer können Anfragen an [email protected] richten.
8.1. Servito haftet nur für Vorsatz und grobe Fahrlässigkeit. Haftung für Personenschäden bleibt unberührt.
8.2. Keine Haftung für Qualität der Gastronomieangebote, Plattformausfälle oder ausstehende Zahlungen.
9.1. Es gilt Schweizer Recht. Gerichtsstand: Baden, Schweiz (für Kaufleute).
9.2. EU/EWR-Verbraucher können ihr Heimatgericht anrufen. EU-Streitbeilegung: ec.europa.eu/consumers/odr

Servito operates a browser-based ordering platform at www.servito.me. Servito does not provide food or beverages and is not liable for the accuracy of listings, ingredients, or allergens.
2.1. These Terms govern all services provided by Servito in connection with the Portal.
2.2. These Terms supplement the Partner Agreement; the Partner Agreement prevails in case of conflict.
2.3. Deviating terms of the restaurant operator require express written agreement to apply.
2.4. Amendments are notified four weeks in advance; no objection within two weeks constitutes acceptance.
2.5. EU/EEA: Mandatory consumer protection laws of the consumer's country of residence apply where more favourable.
3.1. The contract is formed upon signing the Partner Agreement or completing online registration.
3.2. Either party may terminate with one month's notice to the end of a calendar month.

4.1. The Portal is entirely browser-based — no hardware required. Setup within 24 hours.
4.2. The operator receives a personal, non-transferable, revocable licence for the duration of the agreement.
4.3. Copying, modifying, or reverse-engineering the software is prohibited without written consent.
5.1. The restaurant operator is solely responsible for the accuracy of menus, prices, and allergen information.
5.2. Change requests must be submitted at least seven working days in advance in text form.
5.3. The hospitality contract is formed exclusively between the guest and the restaurant operator.
6.1. Servito acts as a limited payment collection agent. Payouts occur monthly.
6.2. Servito receives the fees agreed in the Partner Agreement plus VAT, due upon invoicing.
Data processing is governed by the Privacy Policy, in accordance with Swiss DPA and EU GDPR. EU/EEA users may contact [email protected] for requests.
8.1. Servito is liable only for wilful misconduct and gross negligence. Liability for personal injury remains unaffected.
8.2. No liability for food quality, platform outages, or outstanding payments.

Servito pruža platformu za naručivanje putem preglednika na www.servito.me. Servito ne nudi hranu ni piće i ne odgovara za točnost ponuda, sastojaka ili alergena.
2.1. Ovi Uvjeti primjenjuju se na sve usluge Servita vezane uz Portal.
2.2. Ovi Uvjeti dopunjuju Partnerski ugovor; Partnerski ugovor ima prednost u slučaju proturječja.
2.3. Drukčiji uvjeti ugostiteljskog objekta zahtijevaju izričitu pisanu suglasnost.
2.4. Izmjene se najavljuju četiri tjedna unaprijed; bez prigovora u roku od dva tjedna smatra se prihvaćenima.
2.5. EU/EEA: Prisilni propisi o zaštiti potrošača države boravišta imaju prednost.
3.1. Ugovor se sklapa potpisivanjem Partnerskog ugovora ili online registracijom.
3.2. Otkaz s otkaznim rokom od jednog mjeseca na kraj kalendarskog mjeseca.

4.1. Portal je u potpunosti temeljen na pregledniku — nije potreban hardver. Postavljanje unutar 24 sata.
4.2. Ugostiteljski objekt dobiva osobnu, neprenosivu, opoziva licencu za trajanje ugovora.
4.3. Kopiranje, mijenjanje ili dekompiliranje softvera zabranjeno je bez pisane suglasnosti.
5.1. Ugostiteljski objekt isključivo odgovara za točnost jelovnika, cijena i alergena.
5.2. Zahtjevi za izmjene dostavljaju se sedam radnih dana unaprijed u pisanom obliku.
5.3. Ugovor o usluzi sklapa se isključivo između gosta i ugostiteljskog objekta.
6.1. Servito djeluje kao ograničeni ovlaštenik za naplatu. Isplate se vrše mjesečno.
6.2. Servito prima naknadu dogovorenu Partnerskim ugovorom plus PDV, dospijeva ispostavljanjem računa.

8.1. Servito odgovara samo za namjeru i grubu nepažnju. Odgovornost za tjelesne ozljede ostaje neograničena.
8.2. Nema odgovornosti za kvalitetu hrane, ispade platforme ili neplaćene račune.
9.1. Primjenjuje se švicarsko pravo. Nadležnost: Baden, Švicarska (za poslovne subjekte).
9.2. Potrošači iz EU/EEA mogu tužiti pred domaćim sudovima. Rješavanje sporova: ec.europa.eu/consumers/odr
9.3. Hrvatski korisnici: Primjenjuju se Zakon o zaštiti potrošača (NN 19/2022) i nadležnost hrvatskih sudova.
